Please read this terms of service agreement carefully. By using this website or ordering products from this website you agree to be bound by all of the terms and conditions of this agreement. Booking any of our travel, tour, trip, activity and accommodation or any other product provided by this website www.krabi-tours.org implies the total acceptance of these general conditions and particular conditions given with the trip documentation, tour program or Itinerary.
This Terms & Conditions governs your use of this website, www.krabi-tours.org, KRABI FREEDOM TRAVEL & TOUR offer of travel, tours, trips, activities and accommodations.
for purchase on this Website, or your purchase of products available on this Website. This Agreement includes, and incorporates by this reference, the policies and guidelines referenced below. KRABI FREEDOM TRAVEL & TOUR reserves the right to change or revise the terms and conditions of this Agreement at any time by posting any changes or a revised Agreement on this Website.
Booking your Travel, Tour or Activity
General Information
1. We sell a variety of travel related products and services from different travel, tour or activity operator. KRABI FREEDOM TRAVEL & TOUR, as Booking/Travel Agent, is acting as intermediary for products and services that are not directly supplied by us. We are not a co-vendor of such products and services. When you make a booking via our website, you will be entering into a separate contract with such Travel Suppliers in connection with such products and services. You accept that KRABI FREEDOM TRAVEL & TOUR does not provide any of the above services of your booked product, unless your voucher states “operated by KRABI FREEDOM TRAVEL & TOUR”.
2. You, the user, declare that you are over 18 years of age, and have the necessary legal capacity to contract the services offered in accordance with these general conditions. In case of contracting by a minor, KRABI FREEDOM TRAVEL & TOUR will not be in any case responsible, being at all times the minor, his parents or guardians who will be responsible for the legal consequences and the expenses that may arise from this.
3. You acknowledge that the travel, tour or activity you selected may involve inherently dangerous activities and risks and/or that it may require good or special physical conditions. You agree that KRABI FREEDOM TRAVEL & TOUR shall not be liable for special, indirect, incidental or consequential damages resulting from this. We intend to find the most suitable our, trip or activity for all our customer based on their needs, expectations and capabilities. We therefore reserve the right to refuse bookings in case we find any party member unsuited for the requested tour, trip or activity. E.g. pregnant women, children under age of 3 and handicapped people are not recommended for speedboat tours or rafting tours due to the risks involved. Please don’t hesitate to contact us before booking, we will find the best way according to your wishes and expectation.
4. All bookings on this website are made with KRABI FREEDOM TRAVEL & TOUR. By booking a trip with us you are deemed to have agreed to these booking conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis. The services to be provided are those referred to in your tour, trip and activity itinerary. Furthermore you understand and accept our Privacy Policy statement.
Duties and Obligations of the User
When booking the travel, tour or activity, you must provide all the requested details together with the balance of the total price of the selected product. The necessary details include the full name according to passport, date of birth, nationality, passport number and hotel or accommodation and any pre-existing medical conditions that may affect your ability to complete the travel, tour or activity. Your booking can not be confirmed without giving these details. The data must be correct and the full names. Any error that occurs in the name or any other data provided by you that entails extra costs, visa problems through customs or any other problem attributable, will be at your cost.
It is your responsibility to declare any health issues that may prevent you or any party member from participating in the tour, trip or activity or that may cause potential risk to yourselves or others. Some travel, tour or activity may have certain restrictions based on age, health, weight and/or height, which have been imposed by the supplier. For your own safety, we urge you to abide by them. It is your responsibility to ensure you and your party read all literature carefully for details of the level of the tour, trip or activity and the necessary experience (if any) and/or ability required.
Group sizes may vary from 1 to 99 participants. If the tour, trip or activity you choose does not expressly indicate that it is suitable for less mobile people, it is unsuitable for people with mobility issues. Please be aware that some travel, tour or activity do carry an element of risk and it is your responsibility to ensure that the tour, trip or activity is suitable for you and/or your party and that you are fit enough to join in.
We urge you to check that you have suitable and valid insurance for your tour, trip or activity and optional extras. It is your responsibility to declare any material facts including known medical conditions to your insurers, as failure to do so may result in a claim being reduced or declined.
It is a highly advised when you book with us that you and all other members of your party, including infants and children, are adequately insured on holiday. Any person who is under 18 years old must be accompanied by an adult on his or her tour, trip or activity. There may be other restrictions and conditions on some offers, but these are explained in the details of those offers. Confirmation of your booking will be provided in a printed ticket by our representative (optionally sent to an email address supplied by you instead) if you do not receive this please contact us
Booking, Payment and Voucher/Pax
1. Prices are confirmed at the final step of the booking path at the point when you click “Book Now”, “Apply” or similar, depending on product purchased. The travel, tour or activity package prices are based on currency exchange rates effective of the date of itinerary and are subject to change. All prices are in Thai Baht (THB) free. Any supplements payable locally in the destination (e.g. local payments, entrance fees, tipping etc) will be expressed in the local currency. Where exchange rate fluctuations occur or any other increases in the price of services provided which are beyond our control, we reserve the right to adjust package prices accordingly at any time up until the delivery of the service, irrespective of the reservation payment status.
2. Travel, tour or activity bookings made through our website must be paid in full, in advance by either PayPal, MasterCard, Visa or Bank Transfer. Last minute payments on day for a tour, trip or activity may not be accepted.
3. You are responsible for the payment of any items not listed in the tour itinerary (e.g. National Park entry fees, alcoholic drinks, photographs or videos of the tour) and agree to pay locally for items or services used by your party which are not included in your tour price.
4.Once the payment for your booking has been cleared, we will issue your voucher/pax and send you by email. You can print out the confirmed voucher/pax or keep it ready on your mobile phone to show to the tour operator (best to do a screenshot before). The confirmation voucher is the tour operator’s acceptance of your booking (as detailed therein), and a contract is made between you and the tour operator upon its delivery. We would ask you to check the details on the voucher. Any anomaly should be reported to us immediately, otherwise the details shown on the voucher will be presumed to be correct and confirmed by you.
4. You are responsible to keep the original voucher/pax or email conformation which will be required by the tour operator as proof of purchase when joining the travel, tour or activity. If the voucher is lost, you will not be allowed on the travel, tour or activity. However this is entirely at the decision of the operator, it may involve extra checks to prove your identity. We are not responsible for any delay, inconvenience or loss this may cause.
Amendments & Cancellation of Tours, Trips and Activities
A. Cancellation by Tour Operators
1. You agree and accept that all tour, trip or activity itineraries may vary due to tidal and weather conditions without prior notice. The tour operators are experienced and any changes made will be for your safety and comfort during the travel, tour or activity.
2. We may cancel a tour, trip or activity at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate your planned itinerary or tour.
3. In case a tour, trip or activity is cancelled we will endeavour that you are promptly notified of any significant changes once we become aware of such change if there is time before your departure, but we accept no liability for any changes or costs incurred that may result. Subject to the Supplier’s terms and conditions, you will then have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements if one is made available by the Supplier, or cancelling your booked arrangements and receiving any applicable refunds. We do not guaranty that any refunds will apply. We are not responsible for any incidental expenses that you may have incurred as a result of your booking.
B. Cancellation by You
Refunds are only given on cancellations made at least 48 hours before the published pick up time. If you don’t show to the tour, trip or activity no refunds will be made.
Cancellations of private charters and travel, tour or activity arranged specifically for your party, are non-refundable within 3 days of pick up time.
In the event that you fail to participate in the travel, tour or activity booked, do not show up at time at agreed meeting point, arrive late or depart early. No refund will be issued under any circumstances.
Any cancellation will only be effective when we receive written confirmation via email of the cancellation.
C. Severability
In the event that any term or condition contained in these Terms & Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or conditions shall be deemed.
D. Errors & Omissions
Although we have made a concerted attempt to verify the accuracy of statement made in our tour, trip or activity documentation including website and itinerary, we cannot be held responsible for any error, omission or unintentional mis-representation that may occur. Responsibility, flexibility and itinerary changes you appreciate and acknowledge that the nature of this type of tour, trip or activity requires considerable flexibility and you should allow for alternatives to tour, trip or activity plans. The itinerary provided is representative of the type of tour, trip or activity contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances, political disturbances, events or safety concerns.
E. Disclaimer
It is a pre-requisite of acceptance of traveling/booking with KRABI FREEDOM TRAVEL & TOUR, that all KRABI FREEDOM TRAVEL & TOUR clients or customer remove any form of responsibility from KRABI FREEDOM TRAVEL & TOUR and its staff in the event of personal accident or injury.
F. Tour, Trip or Activity Insurance
The travel, tour or activity operators will provide a basic accident insurance for all travel, tour or activity, typically up to 1,000,000 baht per accident (may vary).
We highly recommend you have a private travel insurance that provide cover against personal accident, death, medical expenses, emergency repatriation and personal liability, with a minimum coverage. We also strongly recommend it cover travel, tour or activity cancellation, curtailment and loss of luggage and personal effects.
G. Registered Address
All matters from this contract are governed by the laws of the Kingdom of Thailand.
